1. Introduction

These Terms and Conditions ("Terms") govern your use of MX Marketplace ("the Platform"), an online classified advertising service that allows users to post and browse listings for motorcycles, ATVs, transport items, spare parts, and breaking bikes.

MX Marketplace is a listings platform only. We do not process payments, hold funds, or facilitate transactions between buyers and sellers. All sales are private transactions conducted entirely between the buyer and seller, independent of MX Marketplace.

By accessing or using the Platform, you agree to these Terms, our Privacy Policy, and any other supplemental policies referenced herein (collectively, the "Policies").

If you do not agree to these Terms, you must not use the Platform.

2. Our Role

We do not own, inspect, or verify the items listed on the Platform. We are not responsible for the quality, authenticity, safety, legality, or fitness for purpose of any listed item.

Any contract formed for the sale or purchase of an item is solely between the buyer and seller. MX Marketplace is not a party to any such contract.

3. Eligibility and Accounts

• You must be at least 18 years old to use the Platform.
• You must provide accurate, complete information when registering and keep it updated.
• You are responsible for maintaining the security of your login credentials.
• You may not create an account on behalf of another person without their authorisation.

4. Listings

• Sellers must accurately describe all items, including any defects, damage, modifications, or relevant history.
• You must have the legal right to sell any item you list.
• You must own or have permission to use all images and content you upload.
• Listings must comply with all applicable laws, including those relating to the sale of vehicles.
• Items prohibited by law or Platform policy must not be listed.
• We reserve the right to remove any listing or suspend any account that violates these Terms or our policies, at our sole discretion and without notice.

5. Transactions Between Users

• All transactions are private arrangements made directly between the buyer and seller. This includes the sale of complete bikes, ATVs, transport, spare parts, and parts sold from breaking bikes.
• MX Marketplace does not process, hold, or facilitate any payment for any listing type, including parts and breaking bikes.
• Buyers and sellers are solely responsible for agreeing terms, arranging payment, and completing any transfer of ownership.
• We strongly recommend buyers inspect items in person before purchasing and use secure payment methods.
• Recommended for parts purchases: When buying spare parts or components from a breaking bike, we strongly recommend using PayPal's "Goods and Services" payment option, which offers Buyer Protection for eligible purchases. This can help protect your payment if an item does not arrive or is significantly not as described. MX Marketplace is not affiliated with PayPal and receives no benefit from this recommendation — it is provided solely to help users transact more safely. Buyers and sellers should always review PayPal's current Buyer Protection terms, as eligibility and cover can change.
• MX Marketplace is not responsible for any loss, dispute, fraud, or dissatisfaction arising from a transaction between users.

6. No Buyer Protection

As MX Marketplace does not process payments or act as an intermediary in any transaction, we do not offer any buyer protection scheme, dispute resolution service, or refund mechanism in connection with any listing on the Platform — including complete bikes, ATVs, transport, spare parts, and breaking bikes.

Users engage in transactions at their own risk. MX Marketplace accepts no liability for any financial loss or dispute arising from a transaction facilitated through a listing on the Platform. Any reference to third-party services such as PayPal Buyer Protection is a general safety recommendation only and does not create any obligation or guarantee on the part of MX Marketplace.

7. User Conduct

• You must not use the Platform for any unlawful purpose or in a way that violates these Terms.
• You must not post false, misleading, or fraudulent listings.
• You must not harass, abuse, or threaten other users.
• You must not attempt to circumvent any security or access controls on the Platform.
• You must not use automated tools to scrape or extract data from the Platform without our prior written consent.

8. Intellectual Property

• You retain ownership of the content you upload, but grant MX Marketplace a non-exclusive, royalty-free licence to display and use that content to operate the Platform.
• You must not upload content that infringes the intellectual property rights of any third party.
• All Platform branding, design, and software remain the property of MX Trader Ltd.

9. Privacy

• Personal data is collected and processed in accordance with our Privacy Policy.
• By using the Platform, you consent to our data practices as described in the Privacy Policy.

10. Platform Availability

• We aim to provide continuous availability but cannot guarantee uninterrupted access to the Platform.
• We may modify, suspend, or discontinue features at any time for operational or security reasons.

11. Liability

• The Platform is provided "as is" without warranties of any kind, express or implied.
• MX Marketplace is not liable for any loss or damage arising from your use of the Platform or any transaction conducted between users.
• MX Marketplace is not liable for indirect, consequential, or incidental losses.
• Nothing in these Terms excludes liability for death, personal injury, or fraud caused by our negligence.

12. Termination

• You may close your account at any time by contacting us.
• We may suspend or terminate your account for violation of these Terms or for any legal or regulatory reason.

13. Changes to These Terms

• We may update these Terms from time to time.
• We will notify users of material changes by updating the "Last Updated" date above.
• Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

• These Terms are governed by the laws of Scotland.
• Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
